It is difficult to be able to express all that we are feeling in these moments, but I believe that it is most necessary to clarify certain points. Above all to the people that have known us for so many years and whose friendship is invaluable after everything that we are living…

The first thing that I would like to clarify is that we totally agree that nobody has the right to abuse any human being, especially a baby. We are parents and as parents we have tried to understand the parents of Noah since the very beginning. Since this happened we haven’t stopped praying in our family, asking for Noah’s improvement.

WHEN THERE IS PHYSICAL ABUSE, MARKS REMAIN. AND NOBODY DEMONSTRATED THAT BABY NOAH HAD THEM.

And, of course, among so much pain we were looking for the explanation of what really happened. With confidence and good faith we assumed that justice would seek for the truth and that all of this would be clarified during the trial. Thus, we looked for renowned specialists certain that they would put all of their knowledge in favor of science and truth.

Through the testimonies of all the specialists and paramedics that analyzed and saw Noah, they exposed a single truth: the baby did not present any bruise nor marks of any kind because nobody shook him…

Either with opened or closed doors when a person abuses someone else visible marks or other type of physical evidence from that violent act remain. Many friends of them comment that a child can not suddenly turn out into those conditions. Situations that we pray should never happen, but please look at this:

When someone has not had any type of legal experience, except for theory or general culture, we TRUST that justice will seek the TRUTH. It is impossible for me to understand given that I work for a government education agency that provides services to children with multiple diagnosis of disabilities and performing a work that demonstrates above all professionalism (maintaining documents and forms that serve to support our opinions on educational issues). I figured it would be a work even more delicate in the judicial system regarding the basic rights that entitled to each human being known through our constitution and international rights. We still can not understand how we have been so blind to what was happening in this country. Looking for a logical explanation I submerged myself to the Internet trying to find reasonable answers, because in this moment of our lives it is difficult to be able to trust again. It is difficult to understand that if someone is innocent they should have the means to be able to demonstrate it… What happened to the concept of someone being innocent until they were PROVED guilty? …or at least that they would grant the benefit of doubt, since when do you keep a person from their freedom without having any proof? Since when a social worker needs no record of the declaration of the witness in their native language and a translated statement of someone, read and signed by the same person being accused? Since when the opinions of recognized specialists are no longer taken into account? Then, what difference makes for professionals that choose to dedicate more years of their lives to investigation and study? Within the 12 members of the jury I observed one Latino, which seemed good to me because I thought he would recognize that the translation that the police official was performing in the audio presented was far from good. The official summarized the explanations that my sister was giving modifying and altering it in a wrong way, very different from the true meaning of what she was saying, and it seems that it didn’t make any difference that someone would understand Spanish within the jury. Is that what really happened with the social worker?
The same one who said that my sister had affirmed having ’shaken’ the baby, something that wasn’t true. She [my sister] took a doll that she had around and demonstrated the way she had rocked the child to console him from his crying …placing one hand behind between the neck and the back, and the other hand supporting the part of his buttocks. In this position it is so difficult that someone is going to be able to “shake” the child in a violent way because he would fall from someone’s hands before being able to do that.

Another thing that the social worker did, is to visit my sister during her first arrest presenting herself as her lawyer, so when my sister came by, this woman assuming the place of her lawyer appeared very arrogant continuing with her ’work’, this time asking her about her daughters and telling her that never more could she care for children, etc. etc. We never really understood the motivation for that visit until I found this information:

How do they explain that there was a violent act without any external sign on Noah? Or at least the existence of some inflammation of the nerves that are connected to the brain with the spinal column. This made us ask ourselves about what was the medical history of the child. Did Noah show symptoms of anemia? What happens when a child has anemia? Does it affect something in the brain? I found this so that you can make your own conclusions:

We are very sorry for what Noah’s family has had to go through but the photos that are shown on the Website aren’t something that my sister has provoked. Those photos are the result of a professional incompetence. I ask myself if there are photos showing the baby’s bruises or physical signs of abuse. Up to the point where the facts were presented during the trial, there were many outrageous errors. First when my sister called 911 she reported that the baby was not breathing. Secondly, she started CPR and kept the baby breathing until the paramedics arrived. This information was sent to the paramedics so that they can anticipate what the medical procedures were about to be taken when they arrive. With only a little bit of knowledge someone could say that they omitted something so basic and vital as to immediately providing oxygen. They didn’t do it. (I assume that everyone knows the damage caused to the brain when it doesn’t receive enough oxygen for more than three minutes.) Through my niece that was present there at that moment, I know that the paramedics were around the baby “observing”. No oxygen was administered to him at that moment. They took him by ambulance to the hospital. How long did that take them? 15 minutes. In that lapse they administered two doses of valium – What else happened during that period of time? The photos that are seen on that Website are the result of that.
It is inadmissible that the prosecutor would affirm that Trudy could also have waited 15 – 20 minutes before calling 911…if she would have waited for that long of time the child wouldn’t be alive today.

From the beginning I tried to sympathize with Noah’s parents, but my perception of them especially of the father was changing. During the recesses in the trial he seemed like a person about to explode. We were all upset, but EACH HUMAN BEING GIVES WHAT THEY HAVE INSIDE. I don’t know if he thought that we didn’t understand English or what was his intention, but he was passing by our side appearing to walk around with one of his relatives while making comments at us. What I am saying is, Is that what a honest person does? The wife writes giving recommendations to our family, what makes her think that she is better than us? What gives her the certainty to accuse my sister of having shaken her son behind a closed door? And how does she explain that there isn’t any sign of external or internal trauma present? I believe that she could go through the bother of giving a more complete and coherent explanation, I agree with all of the recommendations posted on their Website about not ‘shaking’ a child. It is correct, no one should ever violently shake a child, but in this particular case with Trudy I tell you that this is not what has happened. There is much evidence that proves the contrary…

    I read this statement and would like to make the folllowing comment`.

    I attended Ms Munoz’s trial and in my opinion it was more than fair and probably well above the services that would be provided to a native born ameerican who speaks English.

    I personally found the evidence to be overwhelming and it proved Ms. Munoz’s guilt WELL PAST a reasonable doubt.

    She was found GUILTY of felony child abuse by a jury of her peers, a jury approved by Ms. Munoz’s attornies.

    It is time for Ms. Munoz to stand up and be accountable for her actions and accept her sentence when it is handed down in April.

    I hope that she is able to repair her life once her sentence is served and she is expelled from the US for good.

    These ideas are so far fetched and outragous. She is guilty, the sooner you all admit it the sooner everyone involved in this can move on…

    [Admin] Trudy has never accepted shaking little Noah, and there was no evidence or someone who could prove in court she did that beyond reasonable doubt. For that reason this case is far from the end, not until truth and justice prevail.

    Today there was another trial in that courthouse. The very same doctors, the veredict, a lot different. I still have a hope! I still thinking Trudy is going to be free pretty soon!

    Wow. I totally and completely agree with ALL your comments. ( The jury, the other family, the system in general) Also your links and statements regarding the controversy of SBS only confirmed what I suspected. I realize “gut feelings” don’t count in these circumstatnces, but I always felt that Ms. Munoz was innocent.

    I am sorry that you cannot see the truth yourself. It must be hard to be able to accept the truth, and it is totally natural to be defensive and not see past the irrelevant junk that is posted online that has no scientific or medical merit, but the truth is that she was proven GUILTY by a jury of her peers. She is guilty. End of story. I am sure she will keep trying to get out of it, but the truth is so clearly proven, that it is not possible that she will be able to get out of jail sooner.

    But you know, at the end of Trudy’s sentence – max 10.5 years, she will get her whole life back. Little Noah, well no, he won’t. He has been handed a life sentence that can’t be reduced by good behavior. An innocent baby was proven to have been shaken by Trudy – it has been PROVEN.

    I wish all parties involved the best of luck. I wish I could say her sentence was fair, but it is not. A life sentence would have been closer to fair. It’s a sad thing for both parties involved as there are no winners.

    Pedey.. there are other arguments that can be said as well. Today is Trudy’s punishment day. Neither family has won on this however, I do hope justice will be served and she will be given the time deserved to her for the crime she has committed. Whether she meant to shake him or not, she did and in the heat of the moment things happen that we wish we could take back. Please know my prayers are also with her family as her 2 girls will not have a mother for many years. That is very heart wrenching. In the process, don’t be down on the Whitmer’s because it is their child that will always have a sentence of a difficult life. These girls will get their mom back, but that child will never be the same.

    rf : Have you noticed that in the Stafford case the baby shows bruises, and several other injuries? In your pain for the poor Noah you are blind or simple you dont wanna see anything else. What happened to Noah could happen when he was at home, and then you had to find somebody else to blame.
