ALL SBS cases must employ differential diagnosis to establish the facts. The accused and the family of injured kids need the truth. Without all the facts emotions and blaming run amok. In the link below you will find full and summarized pathology reports that expose the actual causes of injury in false SBS cases and it is important to read AT LEAST THE SUMMARIES so that you understand the technical issues in recent SBS legal cases

Many of these reports were the basis of the prosecution dropping ALL charges against the accused care giver.,,including nannies, fathers, boyfriends and moms. What a relief for a family to know the truth. To know what really happened and wild medical guessing games are not the truth.

The pathologist writing the reports in the link below has many times been a court appointed expert witness and so even without financial recourse the accused can get a fair trial. One bright spot! Hi,

I am an ophthalmologist and would be interested in seeing the retinal photos documenting the retinal hemorrhages. The retinal hemorrhages could have been caused by CPR or bleeding disorder.

I would like also to add that Hernani and Trudy are professional people who always help other people in their country. Henani is a lawyer in Peru and he comes from a very traditional family; his father who passed away when he was 5 years old was a very respectably lawyer and one of the tops judges in Ancash who left a remarkable great feelings to all of those who know him. Trudy on the other hand, was a teacher who help many students who are now sad to know what is going on with her. My comments are in regards to of all those people who are judging the situation with no knowing what really had happened. I am only blessing them and remind them that whatever goes around comes around. Keep that in mind

MKJ: You pose an excellent question and here is the answer. The prosecution’s witness Dr. Futterman testified that the minimum amount of force required to caused injuries by SBS is 50gs to 500gs. Yet, studies have shown that no one has ever been able to generate such force. So how can a person cause SBS injury? Is simple. Injury to a child can definitely be cause by a violent shake. However, the injury would be manifested in the spinal chord, the neck to be more precise. Why? because this is one of the weakest part of a baby’s body. So before you even get to the 50 gs, a child’s neck would be severely injured, possibly causing his death. This is before you cause any alleged “SBS” injury inside the brain. All cases were there is an allegation of SBS injury normally are the result of direct trauma to the head and there is generally other evidence of abuse such as broken ribs and bruises. None of these external evidence were present in this case.

Human beings are quite capable of causing severe injury even death to an infant if they violently shaking a child. The cause of the death or severe injury would however be due to the fracture of the neck bones or injury to the spinal chord. What our experts and dozens of scientific studies have concluded is that no human being is capable of generating such high rotational forces (50g to 500g) without breaking the neck first. In other words, when an infant has no external signs of any trauma, i.e. bruises, trauma to the head or neck, it is impossible that such high rotational forces could have been reach because the neck would have been injured first. In studies conducted by biomechanical engineers, it has been clearly demonstrated that humans cannot generate such rotational forces. To give you an an idea of how much force we are talking about, 18gs is the force that is generated when a pilot is ejected from an F-16 fighter jet. 18g! by a jet.

Could you clarify #3 and #4 of your letter?

If the requirement for Shaken Baby Syndrome (SBS) is 50-500 g, and the experts claim that a healthy woman and healthy man can only generate 8g and 20g of force, respectively, then is it the conclusion of your experts that no human being is capable of causing SBS injury on an infant?

That doesn’t seem to make sense. Perphaps, you can clarify this part.

I hear the audio where the police tried to fix everythign to make her look guilty. Hope your letter can be the benning of something good at all. Keep yoursefl positive and hope people like Cris wont ever be in the jury since they do not understand the whole..I was follwing this sad story since i got the invitation in facebook..Please release TRUDY !! I also hate when the race card is played and that should have been left out of the letter…race had nothing to do with the case…period!!!

Chris, How wrong are you. The letter is listing facts based on the Court’s presented and accepted evidence.
This letter clearly reveals the evidence presented to the Jury doesn’t prove beyond reasonable doubt Trudy HAD shaken that baby boy. That is what this letter claims.
I understand how everyone feels about how bad went Noah’s medical condition at one point, but we need to understand that we can’t condemn a person with out fair trial. We need to get right to the truth and seek Justice for all.
